You Have Rights
The constitution of the United States, as well as that of the State of Nevada grant you special rights as a defendant. These rights are guaranteed, no matter what! That means that if any of your rights were violated during your arrest, we may be able to convince the court to dismiss associated evidence, or even dismiss your case. Because we have a deep knowledge of both state and federal constitutional rights, we can guide you in your Las Vegas criminal defense case.
Depending on the offense, your history, and where the criminal charges are filed, there may be unique options available to you in terms of pleas and sentencing. Only an experienced criminal defense attorney can help you decide which avenue to pursue.

What Does a Criminal Defense Attorney Do?
We create hope and opportunities for those who have been accused of a crime.
The key to winning criminal cases is not in knowing their similarities, but in finding the parts of unique elements of each case. A police officer may issue hundreds of tickets in a month, but in your case did he really check if there was a No Parking sign, or did he just assume? Finding these crucial differences is the core of defending you in court.
Basically, criminal defense lawyers use their knowledge and experience to find the pieces of evidence that the prosecutors are hoping go unnoticed, then leveraging them to prove your innocence, offer mitigation, or even get a case dismissed.
What do criminal defense lawyers do on a day-to-day basis?
Here’s a snapshot of a typical day:
- Contact clients through email, phone calls, video calls, or in-person meetings
- Read and analyze case documents, review laws, and examine evidence
- Notate and prepare evidence relevant to a case
- Create a winning strategy to achieve a client’s goals
- Repeat!
It’s not unusual for a criminal defense lawyer to spend months preparing for a case. This gives them a huge advantage over prosecutors who may be overwhelmed with caseloads and unable to prepare as thoroughly. Preparation takes much longer than the actual trial, but that’s how you win.
Defense Lawyers keep things moving
The best criminal defense lawyers have a skilled team behind them, helping to get the work done quickly and effectively. You can’t possibly out-work an entire team of attorneys, paralegals, associates, and support staff. Why not get a powerhouse legal team on your side? The sooner the case is over, the sooner your life gets back on track. That means fewer workdays lost, and lower odds you’ll lose your job. We’re on your side and we want to get your life back to normal, FAST.
Criminal defense attorneys know how Las Vegas prosecutors think
One thing most people don’t realize is that criminal defense lawyers and prosecutors work in the same courtrooms, facing each other over and over again. We see how Las Vegas prosecutors work and the tactics they use. Our good working relationship with the prosecutors throughout Nevada means we are more effective at getting good deals, negotiating affordable bonds, and obtaining concessions. Think of it this way: are you more likely to give a good deal to somebody you know, or to a stranger you don’t trust? Having a criminal defense lawyer represent you to the prosecutors is far more effective than trying to get in their good graces yourself.
Defense lawyers manage your expectations
There are some fights you can win, and some you can’t. However, there are some fights that aren’t worth fighting. Traffic violations are a good example. Almost every traffic ticket (moving violation) comes with a story about how the police acted in error or plain wrong. We have a few options. We could fight it in court, or we could talk to a prosecutor and possibly get it changed to a parking ticket (no moving violation, no demerit points). Would you rather retain a lawyer for hours of work at a cost far higher than the ticket (even if you win), or get it reduced to a parking ticket and pay a simple fine? From traffic violation cases to much more serious criminal offenses, we help you know what to expect, and which options make sense for your finances, your well-being, and your future.
We handle the paperwork
Few things are more daunting and esoteric than legal paperwork: motions, threats, demands, subpoenas, and more. All these documents seem designed to heighten your stress and confusion. Some prosecutors even use court documents maliciously–attempting to make it impossible for you to respond within the rules of the law. We can carry this burden and ensure that the legal documents are answered on time, are mistake free, and fully comply with the rules of law. In the legal system, even slight mistakes or delays can destroy your criminal defense case. Don’t trust an amateur and don’t try to do this yourself. Our defense lawyers manage that legal work for you.
We protect your rights
Nobody is obligated to tell you your rights. The judge doesn’t have to inform you. The prosecution doesn’t have to remind you. The police don’t have to explain them to you. Having an experienced criminal defense lawyer is the only way to know that your rights are protected. The police and prosecutors have decades of training in laying traps for you so they can get a win. We protect you from these traps and force the state to meet the high standards required by our constitution.
Hiring a criminal defense attorney can save you money
What’s better: hiring a lawyer and keeping your job, or saving money but losing your livelihood forever? A good criminal defense lawyer can help protect your career from harsh sentencing agreements or quick plea deals. They know a criminal case outcome can affect you for the rest of your life, especially your income. Even though attorney’s fees can seem high, the price is worth it to protect your assets, your job, and your way of life.
A criminal defense attorney provides emotional support
Dealing with criminal charges is one of the most stressful events a person can face. It’s normal to feel guilt, shame, frustration, and anger. Believe it or not, your defense lawyer can be somebody to vent to. They can provide advice on mitigating stress and moving forward. This is one of the main reasons to choose an attorney you feel comfortable with.
We have handled cases like yours
Our criminal defense team has experience not just defending the innocent, but even includes two former criminal court judges. There’s a good chance that somebody on our team has not only seen a case like yours before but also knows how cases like yours are WON. Experience counts for everything in the world of criminal defense, and Clear Counsel Law Group has an abundance.
Why Do You Need a Criminal Defense Attorney?
Here are some major reasons you ought to get a good criminal defense lawyer instead of going it alone:
First, and most important, there is a huge government entity coming after you. It’s normal to feel some stress and even despair. People like you, facing criminal charges, usually feel a lot better from simply talking to our defense attorneys. Our team can help you understand the reality of your situation, your options, and often help you get charges reduced (if not dropped entirely).
Local, Las Vegas lawyers present the right image
Ultimately, a judge or jury decides your fate. Will they trust somebody who has been accused of a crime more, or will they trust a reputable, well-trained, professional? Judges, prosecutors, and defense lawyers work together for years on hundreds (even thousands) of cases. With a professional on your side, you capitalize on that rapport and familiarity to push for a better outcome for your case.
Objective decision making, not emotional reactions
A criminal defense lawyer remains objective throughout the proceedings. They offer realistic insights into your case and your trial. They inform you about outcomes in other cases like yours and provide insider information to help you make reasonable decisions instead of emotionally charged ones.
Las Vegas criminal defense experts know the deepest parts of the law and how prosecutors will use it against you.
Rules concerning criminal prosecution are buried deep inside a tangle of laws, regulations, standards, and previous court decisions. If you’ve never navigated legal precedent before, you’re in for a shock. A good Las Vegas defense lawyer knows what laws and rulings apply to your case, and what rules the prosecutor will present.
We get it done faster than you can do it yourself
Defense lawyers save you time (and possibly even reduce jail time) by knowing the right people in the system. Where it might take you hours, or days, to find the right person to deal with your issue, we usually only need one call.
Witnesses probably won’t want to talk to you
Many witnesses, including the victim, will understandably refuse to give statements or offer help to the person accused of a crime. They may even fear for their safety. Those same people will speak to a defense lawyer, providing stories and evidence that may help you.
Criminal defense experience beats knowledge and research every time
Practicing law is vastly different from just reading the laws. Think of it like driving: you can read a dozen books about driving, but you don’t really know how to drive until you hit the road. Don’t assume your knowledge can measure up to real legal experience in a Las Vegas criminal courtroom.
Criminal defense Attorneys understand the Las Vegas system
At Clear Counsel Law Group, our Las Vegas criminal defense lawyers will ensure that you fully understand your rights, your options, and how your future may be affected by the choices you make in court. Facing criminal charges can be terrifying and confusing. Getting experience on your side is like having a cheat sheet. We know how to answer the challenges prosecutors bring. We know what your real options are –including the options the other side doesn’t want you to know.
It is our job to help you not only understand the charges they are making, but the long-term effects of plea deals, penalties, and convictions. We are there, fighting every step of the way. With a criminal defense lawyer on your side, you will be truly informed when facing these major decisions.
Las Vegas prosecutors don’t like to negotiate with DIYers
Even if you want to plea bargain, a criminal defense lawyer can act as the go-between for you and the prosecutor. They work to reduce penalties and sentences, or even eliminate some of the charges against you. A lawyer has LOTS of experience making these kinds of negotiations, improving your chances of securing a deal. Bottom line, prosecutors are often reluctant, if not outright unwilling, to negotiate with defendants who represent themselves.
Our team knows more than the police about what they are allowed to do
An experienced criminal defense lawyer knows if the police violated your rights or not. There are many things the police aren’t allowed to do, and they don’t even know it. Police are not lawyers and can act outside of their duties, resulting in a violation of your rights. We’ve handled cases involving police mistakes before and we know how to win.
Experience with long-term effects of plea agreements
Defense lawyers know the long-term (and unseen) consequences of a sentence or accepting a plea agreement. If you plead guilty to criminal charges, will it affect your ability to find work in the future? Restrict where you can live? Bar you from voting or owning property? Criminal defense lawyers work to fully inform you about the consequences and guide your decision making in stressful times.
We know how to get the talented investigators and experts
Part of your case might involve finding and hiring investigators and expert witnesses. Criminal defense attorneys have a deep “bank” of experts to draw from. They know who is right for the job and who isn’t. Investigators can be used to find out details of the alleged crime and look into witnesses and their claims.

Frequently Asked Questions
If you are arrested in Las Vegas, NV, and not released right away, you will most likely be taken to the Clark County Detention center. It is there that processing happens, people wait for trial, and where offenders serve brief sentences for misdemeanor convictions. You can check if someone is in the Clark County Detention Center on their website here:
https://www.clarkcountynv.gov/government/departments/detention_center/inmate_search.php
After an arrest it can take a while before trial. Before the trial you might be released “on your own recognizance” (O.R.), released on bail, or held in custody in the Clark County Detention Center until your trial. Judges decide bail amounts or if bail is allowed at all. In the most serious cases, criminal law judges can choose to disallow bail. Bail is often paid in cash or bond; in rare cases it is set as cash only.
When somebody violates the rules of the court, a judge might issue a “bench warrant”. The most common situation where a bench warrant is issued is when somebody misses their court date. Once a warrant is issued, a police officer can arrest you at any time.
The law states that you can choose to represent yourself in a Las Vegas court. That doesn’t mean it’s a good idea. Most people who represent themselves (pro se) lose their case. Knowing court procedures is essential and it isn’t realistic for a person to successfully represent themselves in court without this knowledge and experience.
Anybody who has seen Law and Order knows that the police always say, “If you can’t afford an attorney, one will be provided for you.” The court appointee is called a public defender. Public defenders are an essential part of the court’s adversarial system, but they are often overworked. We can advise you if a public defender is a good option based on your situation and resources. Your best option, if you can afford them, will always be an experienced lawyer. A private criminal defense law firm like Clear Counsel Law Group has far more time and resources to devote to your case than any public defender.
It can be tricky to locate somebody who has been arrested. It usually means calling a few different places. Remember, if your friend or loved one hasn’t been booked into the system yet, the person answering the phone will not know if they are at their location.
